In consideration of this reservation and the payment of the appropriate fees, Atlantic Yachting LLC agrees to reserve a vessel and to hire captains and crew.
Charter Fee is deemed earned upon placing a hold for desired date and time. In the event of a cancellation by the Captain of the vessel due to severe weather conditions or mechanical failure, the Charterer will be offered two (2) alternative dates prior to October 15 of the current season to reschedule at no additional charge. Refunds are not offered. Catered good are the property of the Charterer and must be paid for prior to the charter date. In the event of a postponement, catering can be delivered within Manhattan at no additional cost. Severe weather is determined solely by the Captain of the vessel.
Charterer¹s requests for rescheduling will be considered on a case by case basis and are subject to a rescheduling fee of $25. Within two weeks of the reservation date the fee is $100, within 48 hours the fee is $200. A 15% crew gratuity will be added to charters of 4 hours or more. A fee of $95 per hour will be assessed for early dropoff of goods / catering / drinks.
If it is necessary to obtain medical/surgical/dental services for the participant, regardless of cause, such expenses shall be paid by the participants. Authority is granted without limitation to Atlantic Yachting LLC / /its assigns in all medical matters to hospitalize/treat/order injection/anesthesia/surgery for the participant.
Participant, by this instrument, hereby exempts and releases Atlantic Yachting LLC, United States Sailing Ltd, and their members, agents, servants and employees from all liability and responsibility for personal injury, property damage or wrongful death however caused, including, but not limited to, product defect or the negligence of the released parties.
Disputes shall be governed by Federal Maritime law. In any action against Atlantic Yachting LLC, United States Sailing Ltd, or its members, agents, partners, employees, or servants which results in a decision/judgment/decree/order/ stipulation or settlement substantially upholding Atlantic Yachting LLC / United States Sailing Ltd's position, the adversary party shall reimburse Atlantic Yachting LLC attorney's fees, court costs and expenses.
